Administrative Changes to Ontario Probate Forms
As part of the changes to the Ontario estate court forms effective January 1, 2022, the following administrative changes have also been implemented.
The following forms have been renumbered per the table below.
Meanwhile, the following Small Estate Certificate forms have been updated to clarify wording and to add a new field to collect the deceased’s county/district of residence.
- Form 74.1A Application for a Small Estate Certificate
- Form 74.1B Request to file an Application for a Small Estate Certificate or an amended Small Estate Certificate
- Form 74.1C Small Estate Certificate
- Form 74.1E Application to Amend Small Estate Certificate
- Form 74.1F Amended Small Estate Certificate
Unlike in the Application Forms 74A and 74J, the applicant must list the deceased’s assets in the Application for a Small Estate Certificate (as opposed to only listing the total value of the deceased’s real property and personal property). The total value of these assets should not exceed $150,000.
As of January 1, 2022, the Application for a Small Estate Certificate and the Application to Amend Small Estate Certificate have been slightly modified to clarify that the applicant should not provide any bank account numbers. This is consistent with the approach in Form 74.1C Small Estate Certificate.
Lastly, the links in the Notice on the Application and the Application to Amend Small Estate Certificate (Forms 74.1A and 74.1E) have been updated.
