2022 Changes To Ontario Probate Form 74G – Renunciation

Form 74G is a new Ontario estate court form effective January 1, 2022, replacing probate Forms 74.11 and 74.18. This article reviews the changes in detail.

Changes to Ontario Probate Form 74G

Form 74G Renunciation replaces: 

  • Form 74.11 Renunciation of Right to a Certificate of Appointment of Estate Trustee (or Succeeding Estate Trustee) with a Will
  • Form 74.18 Renunciation of Prior Right to a Certificate of Appointment of Estate Trustee without a Will

As seen on the other new Ontario estate court forms effective January 1, 2022, the Renunciation replaces the two previous versions (with and without a Will).

As such, the persons renouncing must select the checkbox that is appropriate for their situation.

Additionally, in the case of an intestacy, the persons renouncing must indicate whether their right to apply for a Certificate of Appointment of Estate Trustee was in priority, or in equal right, to the applicant.
